Terms of Service

1. Acceptance of Terms

By accessing and using E-Waste Jobs ("the Platform"), operated by Grow Easy Systems, you agree to be bound by these Terms of Service and all applicable laws and regulations of South Africa. If you do not agree with any of these terms, you are prohibited from using this Platform.

2. Platform Description

E-Waste Jobs is an online job board platform connecting job seekers with employers and recruiters in the e-waste, recycling, and refurbishment industry. We provide a platform for:

• Job seekers to create profiles, upload CVs, and apply to job listings
• Employers to post job opportunities and review applications
• Recruiters to post jobs for clients and access candidate databases

3. Account Registration and Fees

3.1 Registration Requirements

All users must:

• Provide accurate, current, and complete information
• Be at least 18 years of age
• Have legal capacity to enter into binding contracts
• Maintain the security of their account credentials

3.2 Fees and Payment

• Job Seekers: One-time registration fee of R50.00 (non-refundable)
• Employers: Weekly subscription of R500.00 per week
• Recruiters: Monthly subscription of R1,500.00 per month

All payments are processed securely through Grow Easy Systems shop using PayFast payment gateway.

3.3 Account Approval

All accounts are subject to administrative approval. Grow Easy Systems reserves the right to approve or reject any account registration at our sole discretion. Account activation typically occurs within 24 hours of payment confirmation, but we make no guarantees regarding approval timeframes.

4. User Responsibilities

4.1 Job Seekers Agree To:

• Provide truthful and accurate information in their profiles and CVs
• Not misrepresent qualifications, experience, or skills
• Conduct themselves professionally in all communications
• Understand that their information will be shared with employers and recruiters as described in the Privacy Policy

4.2 Employers and Recruiters Agree To:

• Post only legitimate job opportunities
• Provide accurate job descriptions and requirements
• Comply with South African labour laws and employment equity legislation
• Not discriminate based on race, gender, age, disability, or other protected characteristics
• Handle candidate information responsibly and in accordance with POPIA
• Not use the platform for fraudulent purposes

5. Prohibited Activities

Users are strictly prohibited from:

• Posting false, misleading, or fraudulent job listings
• Posting job listings that violate South African law
• Harvesting or collecting user data without authorization
• Spamming, harassing, or abusing other users
• Using automated systems (bots) to access the platform
• Impersonating another person or entity
• Uploading malicious files or viruses
• Attempting to gain unauthorized access to the platform or other user accounts

6. Disclaimers and Limitations of Liability

6.1 Platform Provided "AS IS"

The Platform is provided on an "AS IS" and "AS AVAILABLE" basis without any warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

6.2 No Guarantee of Results

Grow Easy Systems does NOT guarantee:

• That job seekers will secure employment through the platform
• That employers or recruiters will find suitable candidates
• A minimum number of job listings on the platform
• A minimum number of registered users (job seekers, employers, or recruiters)
• The availability, quality, or suitability of any job listings
• The accuracy or truthfulness of information posted by users

6.3 No Responsibility for User Content

Grow Easy Systems is NOT responsible for:

• Fake, fraudulent, or misleading job listings posted by employers or recruiters
• False information in job seeker profiles or CVs
• Scams, fraud, or deceptive practices by any users
• Employment disputes between job seekers and employers
• Discrimination or unfair labor practices by employers or recruiters
• The conduct, actions, or omissions of any users
• Loss of data, opportunities, or employment prospects

6.4 Third-Party Verification

While we implement account approval processes, we do not verify:

• The legitimacy of companies or recruiters
• The accuracy of job listings or requirements
• The qualifications or credentials of job seekers
• The existence of advertised positions

Users must conduct their own due diligence before engaging in employment relationships or sharing sensitive information.

6.5 Limitation of Liability

To the maximum extent permitted by South African law, Grow Easy Systems, its directors, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of profits, revenue, or business opportunities
• Loss of data or information
• Loss of employment or employment opportunities
• Damages resulting from fraud or misrepresentation by other users
• Any damages arising from your use of or inability to use the platform

Our maximum liability shall not exceed the amount you paid to us in the 12 months preceding the claim.

7. Refund Policy

By completing payment, you acknowledge and agree that:

• Job Seeker fees (R50): Non-refundable once account is approved
• Employer subscriptions (R500/week): Non-refundable, no pro-rata refunds for unused time
• Recruiter subscriptions (R1,500/month): Non-refundable, no pro-rata refunds for unused time
• No refunds will be issued due to lack of job listings, candidates, or results
• No refunds will be issued if you are dissatisfied with the platform
• No refunds will be issued for account suspensions or terminations due to Terms violations

8. Subscription Terms

8.1 Employers (Weekly Subscription)

• Subscription period: 7 days from activation
• Cost: R500.00 per week
• Renewal: Manual renewal required before expiry
• Expiry: Account deactivated if not renewed

8.2 Recruiters (Monthly Subscription)

• Subscription period: 30 days from activation
• Cost: R1,500.00 per month
• Renewal: Manual renewal required before expiry
• Expiry: Account deactivated if not renewed

8.3 Cancellation and Expiry

• You may cancel your subscription at any time by not renewing
• No refunds will be provided for early cancellation or unused subscription time
• Upon expiry, your account will be deactivated but data will be retained
• You may reactivate by purchasing a new subscription

9. Intellectual Property

All content on the Platform, including text, graphics, logos, and software, is the property of Grow Easy Systems or its licensors and is protected by South African and international copyright laws.

Users retain ownership of their submitted content (CVs, job listings, profiles) but grant us a non-exclusive, worldwide license to use, display, and distribute such content for the purpose of operating the Platform.

10. Account Termination

We reserve the right to suspend or terminate your account at any time, without notice, for:

• Violation of these Terms of Service
• Fraudulent activity or misrepresentation
• Abusive behavior toward other users
• Non-payment of subscription fees
• Any reason we deem necessary to protect the platform or other users

Terminated accounts are not eligible for refunds.

11. User Safety and Due Diligence

Job Seekers:

• Verify the legitimacy of companies before attending interviews
• Never pay money to secure a job
• Research companies independently
• Be cautious of job offers that seem too good to be true
• Meet in public places for interviews when possible
• Report suspicious activity to us immediately

Employers and Recruiters:

• Verify candidate credentials and references
• Conduct background checks as required by law
• Comply with all employment legislation
• Do not rely solely on information provided on the platform

12. Content Moderation

While we implement account approval processes and may review content, we:

• Do not guarantee the accuracy of any user-submitted content
• Are not obligated to monitor all content continuously
• Reserve the right to remove any content at our discretion
• May, but are not required to, investigate reports of policy violations

13. Platform Availability

We strive to maintain platform availability but do not guarantee:

• Uninterrupted access to the platform
• Error-free operation
• That the platform will meet your specific requirements
• A minimum number of job listings or users at any time

The platform may be unavailable due to maintenance, updates, technical issues, or circumstances beyond our control.

14. Privacy and Data Protection

Your use of the Platform is also governed by our Privacy Policy, which complies with POPIA. By using the Platform, you consent to the collection, use, and sharing of your information as described in our Privacy Policy.

15. Indemnification

You agree to indemnify, defend, and hold harmless Grow Easy Systems, its directors, employees, and affiliates from any claims, losses, damages, liabilities, and expenses (including legal fees) arising from:

• Your use of the platform
• Your violation of these Terms
• Your violation of any rights of another user
• Your content or information posted on the platform
• Employment disputes or relationships formed through the platform

16. Governing Law and Jurisdiction

These Terms of Service shall be governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the South African courts.

17. Modifications to Terms

We reserve the right to modify these Terms of Service at any time. Changes will be effective immediately upon posting. Your continued use of the platform after changes constitutes acceptance of the modified terms. We will update the "Last Updated" date at the top of this page.

18. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
